WHAT IS GUARDIANSHIP?

Guardianship is a legal process whereby a court appoints someone to make decisions for another person who is unable to manage their personal or financial affairs​. The appointed guardian is entrusted with the care of the ward and is given authority to act in the ward’s best interests. This arrangement can cover personal decisions (healthcare, living arrangements, education, etc.) and financial decisions (managing income, property, and bills) for the ward. Because establishing a guardianship transfers significant rights from the ward to the guardian, Texas courts only impose guardianship when absolutely necessary and tailor the guardian’s powers to the ward’s actual needs and limitations​. In other words, the court will seek the least restrictive solution that still protects the individual, encouraging as much self-reliance and independence as possible for the ward​.

When does guardianship become necessary?

Guardianship is generally considered when an individual cannot effectively care for themselves or manage their affairs due to age or incapacity, and no less-restrictive alternative is available. For example, a child who has no capable parent, or an adult who is incapacitated (unable to provide food, clothing, or shelter for themselves or to care for their own physical health or finances due to a mental or physical condition​), may require a court-appointed guardian. In Texas, a minor is automatically considered incapacitated by law (due to being under 18), and certain adults can be found incapacitated by the court if evidence shows they cannot take care of their personal needs or property. In such cases, establishing a guardianship ensures that a responsible person has the legal authority to make decisions to protect the health, safety, and financial well-being of the incapacitated individual.
