Before September 30th, 1989, elderly couples were often forced to divorce because there were little to no protections for a community spouse who remained at home while the other was receiving Medicaid benefits in a nursing home. However, the federal government has provided a way for a spouse who remains home to be able to retain enough resources to provide for his or her care.
